Dear Colleagues:
I was informed late last week that San Juan Elementary School had a Mandatory In-Service on Saturday. I was also informed that staff members who did not attend the Mandatory In-Service were disciplined in some manner.
This is a gross breach of contract. Our contracts spell out the number of days we will work, and the number of hours we will work each day. There is some wiggle room in that they specify we will perform duty at the discretion of the Superintendent. This means that going to faculty meetings, doing bus duty etc. is covered but not specifically spelled out. It is something we can bargain over when we have finished the CB process. However no where in our contracts does it say we are required to work on normal days off. Saturdays are normal days off.
Espanola-NEA believes that requiring staff to attend Saturday In-Services and especially disciplining non attendance is an error on the administrations side that can and should be grieved and will fully back any and all members who wish to file a grievance.
This will require full documentation of what was required of you that is non conforming, and what disciplinary procedure was imposed upon you for not attending.
Please contact me if you wish to pursue this issue. It is my intention that all duty will be on the table when we finish the CB process.
